When you prepare to ship your product outside the US be aware that Export Compliance is the law. The penalties for non-compliance are severe, and fines in the hundred of thousands to millions and jail are not out of the question. In the United States 100% of all exports are controlled by one of two agencies. Approximately 95% of all exported products fall under the jurisdiction of the Department of Commerce and the remaining 5% under the Department of State (ITAR). If your business exports, you are responsible to know the difference between what is a commercial product and what is a defense or military product. The initial determination is based on the specifics found in the US Munitions list, all ITAR exports require a State Department License. Regarding commercial products, you must locate the appropriate Export Commodity Classification Number (ECCN) to determine if a Commerce department license is required. Then you will require an End Use Statement from the customer and you must ascertain if the country, customer or individual is listed on any US restriction lists. These requirements are best met with a detailed Export Compliance Plan and detailed employee training to insure compliance and an adequate document trail.
